Kessler Law represents lenders, investors and borrowers in secured and unsecured loan transactions.

We represent clients in the purchase and sale of mortgage loans, handling legal due diligence (including title review) and negotiation and closing of loan purchase agreements.  In addition, after closing we commence (or continue) foreclosure actions, strict foreclosure actions and suits for money judgments.  We also handle the workout of non-performing loans.

Our firm has experience across a wide range of asset classes, including commercial, multi-family, condominiums and cooperatives, residential and hotels.  We also represent private lenders.  We prepare and negotiate loan and security documents, including commitment letters, notes, mortgages, personal guaranties, construction loan agreements, assignments of leases and rents, UCC filings, security agreements and deeds-in-lieu.

We undertake pre-foreclosure title review, notices of default, foreclosure actions, deed-in-lieu transactions, short sales, forbearance agreements, motions for appointment of rent receivers, Sheriff sales, REOs, evictions, ejectment actions and fraudulent conveyance litigation.

We are also experienced in enforcing unsecured promissory notes, personal guaranties against individuals and, where appropriate, litigating foreclosure deficiency judgments.
